Privacy Policy

This privacy policy is issued on behalf of B2EBIKE (the ‘Company’), a société par actions simplifiée (SAS) incorporated under French law, whose registered office is located at 80 rue du Bourbonnais 69009 Lyon, France, registered under number 821 744 521 with the Lyon Trade and Companies Register and which operates the ‘OOWI’ self-service electric bicycle solutions.
B2EBIKE respects your privacy and is committed to protecting your personal data. This Privacy Policy will tell you more about how we handle your personal data when you use our mobile application ‘OOWI’ (the ‘Application’) or use our electric or hybrid bicycles (the ‘Bikes’). It will also tell you about your privacy rights and how the law protects you. Our services are not intended for children under the age of 16 and we do not knowingly collect data from children. The details are set out in our GENERAL CONDITIONS OF ACCESS TO AND USE OF B2EBIKE's OOWI® SERVICES.

We regularly revise our privacy policy and therefore invite you to consult this web page or the application on a regular basis. It is important that the personal data we hold about you is accurate and up to date. If your personal data changes during the course of your relationship with us, please inform us via the Application or by email to contact@b2ebike.com.

2. WHAT PERSONAL DATA MAY WE COLLECT?
The term ‘Personal Data’ means any information relating to an identified or identifiable natural person who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier, etc.

We may collect, use, store and transfer various types of personal data about you (i.e. any information that enables you to be identified directly or indirectly) grouped as follows:

  • Data relating to your identity and contact details: this includes your first name, surname, user name, password, e-mail address, telephone numbers and other similar identifiers.

  • Financial and transactional data: this includes certain information relating to your bank account and payment card as well as any information relating to payments you have made and any other details relating to services you have purchased from us and similar details. Please note that we do not store your full payment card details. This information is stored by our approved third party payment partner.

  • Technical and Usage Data: this includes information about how you use our App and Bikes (including your journey history and location), the type and version of the operating system of the phone you are using.

  • Profile data: this includes the services and subscriptions you have selected.

If we need to collect your personal data under our Terms and Conditions and you do not provide us with the requested data, we may not be able to perform the contract we have entered into or are trying to enter into with you. In which case, we may also be unable to authorise you to use the Application.

3. HOW AND WHY DO WE COLLECT THIS DATA?
By creating an account in the Application, you provide the information requested and, as a User, you consent to the collection and processing of your Personal Data by the Company or any designated service provider, in accordance with all applicable regulations on the protection of personal data, in particular the provisions of the General Data Protection Regulation no. 2016/679 of 27 April 2016 (RGPD), the French Data Protection Act no. 78-17 of 6 January 1978, as amended in particular by Act no. 2018-493 of 20 June 2018, and the French Act for Confidence in the Digital Economy no. 2004-575 of 21 June 2004.

The Company is responsible for processing the Personal Data collected as part of the Services.  In any event, the Company undertakes to comply with the laws and regulations in force relating to the protection of privacy.

The Personal Data collected by the Company is strictly necessary for the management and performance of the Services (billing, payment, access to Bicycles, customer service, journeys, etc.). This personal data (telephone number, surname, first name, email and bank details) and the application are transmitted to the STRIPE payment platform ‘.

You can choose whether or not to be able to track your journeys using the application: the request is made explicitly in a dedicated window. If you choose ‘yes’ to this request, the application traces the location in the background to give you access to tracking and trip statistics. If you choose ‘no’, location tracking is not activated in the background. This feature is only used during the journey.

In this context, as a User you accept that certain information collected about you may be processed in a country outside the European Union, the Company endeavouring to take appropriate measures to maintain an optimum level of confidentiality and security of your Personal Data, in particular by requiring all its subcontractors and service providers to implement all appropriate technical and organisational measures, on an ongoing basis, to secure this Personal Data ensuring the same level of protection as that required by French and Community regulations on Personal Data.

You accept that your Personal Data may be stored, processed and transferred by the Company to its subcontractors or service providers for the purposes mentioned above, who may only access it in compliance with the legal and regulatory provisions in force.

The Personal Data collected also enables the Company to send you promotional offers or inform you of new services.

 

4. HOW LONG WILL WE USE YOUR PERSONAL DATA? 
We will retain your personal data only for as long as is reasonably necessary to fulfil the purposes for which we collected it, including for the purposes of complying with any legal, regulatory, tax, accounting or reporting requirements. We may keep your personal data for longer in the event of a claim or if we reasonably believe that a dispute is likely to arise in connection with our relationship with you. In determining the appropriate retention period for personal data, we will take into account the amount, nature and sensitivity of the data in question, the risks of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data, whether we can fulfil those purposes by other means and any applicable legal, regulatory, tax, accounting and other requirements.

In certain circumstances we will anonymise your personal data irreversibly (so that it can no longer be used to identify you) for research and statistical purposes, in which case this policy will cease to apply and we may use such data indefinitely without further notice.

 

Please note that we are legally obliged to retain basic information about our customers for seven years after they cease to be customers for tax purposes.

5. DATA SECURITY
We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or consulted in an unauthorised manner, altered or disclosed. In addition, we restrict access to your personal data to our employees, representatives, subcontractors and other third parties who need to know it in order to carry out their duties. These third parties will only process your personal data on our instructions and are subject to an obligation of confidentiality. We have procedures in place to deal with any suspected breaches of personal data and will notify you and any relevant regulatory body of any breaches if we are legally required to do so.

6. WHAT ARE YOUR LEGAL RIGHTS?
B2eBike is committed to respecting the legal rights of its customers in relation to data protection. If you send us an enquiry about your rights under data protection law, we will respond within one month of receipt and endeavour to deal with the enquiry within the same period. If necessary, this period may be extended by a maximum of two months if the request is complex.

In accordance with the French Data Protection Act of 6 January 1978, as amended from time to time, and the General Data Protection Regulation, as a User you have the right to access, rectify, delete, object to and port your Personal Data, as well as the right to limit the processing carried out by the Company in relation to this Personal Data:
